Welcome to KOANimation Studios ("KOANimation," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of koanimationstudios.com, the KOANimation Studio web application, and any related services (collectively, the "Service"). By creating an account, making a purchase, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or legal guardian, and they agree to these Terms on your behalf. The Service is not intended for children under 13.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at support@koanimationstudios.com if you suspect unauthorized use.
KOANimation Studios is a creative tool that uses third-party AI models (including but not limited to those provided by fal.ai, Anthropic, OpenAI, Google, ByteDance, Kuaishou, and Alibaba) to generate images, videos, and audio based on prompts and reference materials you provide. Your generations are processed through these third-party providers; we do not control their model behavior or output.
Access to most generation features requires an active paid subscription. Subscriptions renew automatically until cancelled. You can cancel at any time from your account settings or by contacting support; cancellation takes effect at the end of the current billing period.
Credits are deducted when a generation is submitted, and refunded automatically if the underlying model fails to return a result. Credits are non-transferable and have no cash value outside the Service. Unused credits expire at the end of your billing period unless your plan explicitly states otherwise.

"Your Content" means anything you upload, prompt, or generate using the Service — including reference images, training data, prompts, and generated outputs.
You retain ownership of Your Content, subject to (a) the licenses you grant us below and (b) the underlying model providers' terms (some models, such as OpenAI's Sora, retain rights you should review on their platforms).
You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display Your Content solely to operate, improve, and provide the Service to you. If you mark a generation as public, you additionally grant us a license to display it on our public showcase pages until you remove it.
You represent that you have all necessary rights to upload Your Content and that it does not violate any third party's rights or applicable law.

The AI models used by the Service have their own usage rules. By generating with a given model, you also agree to that model provider's acceptable use policy. We pass commercial use rights through to you where the underlying provider grants them; you remain responsible for confirming licensing for your specific use case.
The Service interface, design, code, documentation, and marketing materials are owned by KOANimation Studios and protected by copyright and trademark law. Nothing in these Terms grants you rights in the KOANimation brand, logos, or non-user-generated content beyond what is necessary to use the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATIONS WILL MEET YOUR EXPECTATIONS. AI MODEL OUTPUT IS PROBABILISTIC; YOU ASSUME ALL RISK FOR DECISIONS YOU MAKE BASED ON IT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KOANIMATION STUDIOS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, fail to pay amounts owed, or pose a risk to the Service or other users. On termination, your rights under these Terms end immediately. Sections 5 (content licenses surviving public showcase), 8 (IP), 9–10 (disclaimers, limits) survive termination.
We may update these Terms from time to time. If we make material changes, we will notify you by email or in-app notice at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance.
These Terms are governed by the laws of the jurisdiction in which KOANimation Studios is established, without regard to conflict-of-law rules. Any dispute will be resolved in the courts of that jurisdiction, except where consumer-protection law in your country gives you a different right.
